These Terms and Conditions ("Terms") apply to all purchases made through our website [www.wivva.com.au] (http://www.wivva.com.au]) ("Website") or directly with us.
By placing an order, you agree to be bound by these Terms.
We are WIVVA Tide & Terra Treasures ("we", "us", "our").
1. Formation of Contract

No contract exists until we accept your order by sending you an order confirmation email and payment has been successfully processed.

We reserve the right to refuse or cancel any order (including after confirmation) for reasons including (but not limited to): pricing errors, unavailability of stock, inability to verify payment, suspected fraud, or failure to meet our quality standards.

All descriptions, images, and specifications on the Website are approximate. Because our jewellery is handmade, slight variations in appearance, size, colour, finish, stone placement, or other details are normal and do not constitute a fault.
2. Pricing and Payment

All prices are in Australian Dollars (AUD) and include GST where applicable.

Prices exclude shipping/delivery costs, which are displayed during checkout.

We reserve the right to change prices at any time, but changes do not affect orders already accepted.

Payment is processed securely via our third-party payment provider(s). We do not store your full payment card details.

You must pay the full price (including shipping and any other applicable charges) at the time of ordering.
3. Delivery & Shipping

We aim to dispatch orders within [2] business days (excluding weekends/public holidays). Handmade and custom items may take longer — estimated dispatch/ready times are stated on the product page.

Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs (for international orders), or events beyond our reasonable control.

Risk in the goods passes to you upon dispatch.

Title in the goods remains with us until full payment is received.

For international orders: You are responsible for any import duties, taxes, customs fees, or other charges. We have no control over these.
4. Australian Consumer Law – Consumer Guarantees (Mandatory)Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a repair, replacement, or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
What this means in practice for our handmade jewellery:

Goods must be of acceptable quality (safe, durable, free from defects, acceptable in appearance/finish, and fit for any purpose made known to us).

Because items are handmade, minor variations (e.g. slight asymmetry, tool marks, natural inclusions in stones) are characteristics of the product and not defects.

Normal wear and tear, damage from misuse (e.g. chemicals, impacts, improper cleaning, wearing during heavy activities/swimming), or failure to follow care instructions are not covered.
Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law except to the extent permitted by law.
5. Returns, Refunds, Repairs & Exchanges

Change of mind — We do not offer refunds, exchanges, or credits for change of mind on custom, personalised, or made-to-order jewellery (e.g. engraved, resized, or commissioned pieces). For non-custom items, we may offer exchanges at our discretion if the item is returned unused, in original condition, with all tags/packaging within 14 days of delivery. Return shipping is at your cost.

Faulty/damaged goods — If you believe an item has a manufacturing fault (not normal handmade variation), contact us within a reasonable time (ideally within 30 days) with photos and details. We will assess under the consumer guarantees. If a major failure is found, you may choose refund, replacement, or repair. If not a major failure, we may repair the item.

Returns must be sent back to us in original packaging with proof of purchase. We recommend using tracked/signed-for postage.

Refunds are processed to the original payment method within [5] business days of receiving and assessing the return.
6. Custom & Personalised Orders

Custom/handmade items are made specifically for you and are generally non-returnable for change of mind.

We will provide a proof or description for approval where possible. Minor adjustments after production may not be possible.

We reserve the right to refuse or cancel custom orders if materials become unavailable or if we cannot meet your requirements.
7. Care & Maintenance
Jewellery care instructions are provided with your purchase and/or on our Website. Failure to follow these (e.g. exposure to chemicals, chlorine, lotions, extreme temperatures) may void your ability to claim under consumer guarantees for certain issues.
8. Intellectual Property

All designs, photographs, content, and intellectual property on the Website are owned by us or our licensors.

You may not reproduce, copy, or use our designs without written permission.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, consequential, or special loss, or for loss caused by events beyond our reasonable control.
10. Governing Law
These Terms are governed by the laws of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of that State/Territory.
11. Changes to Terms
We may update these Terms from time to time. The current version is displayed on the Website with the last updated date. Continued use of the Website/orders after changes constitutes acceptance.
